Snag Reserve — Terms of Service

Welcome to Snag Reserve ("Snag Reserve," "we," "us"). These Terms of Service ("Terms") govern your access to and use of the Snag Reserve mobile app, website at snag-res.app, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Snag Reserve Does
Snag Reserve is an automation tool that, on your behalf and at your direction, monitors publicly available reservation inventory on third-party restaurant reservation platforms and attempts to secure reservations that match criteria you configure. Snag Reserve does not operate any restaurant, does not own inventory, and does not guarantee that any reservation attempt will succeed.
You understand that:
- Availability on third-party reservation platforms is outside our control and can change instantaneously.
- Restaurants and reservation platforms may impose their own fees, cancellation policies, no-show penalties, deposits, and prepayments. These are your responsibility.
- A successful reservation is not guaranteed and is not the basis on which you are charged your Snag Reserve subscription.
2. Eligibility and Accounts
You must be at least 18 years old to use the Service. You agree to provide accurate information during signup and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
3. Your Authorization to Snag Reserve
By configuring a reservation request, you authorize Snag Reserve to act as your limited agent for the purpose of submitting that request to the relevant third-party reservation platform. You retain full responsibility for the parameters you set, including restaurant selection, date, time window, party size, and acceptance of any restaurant-imposed fees or cancellation terms.
If you link a third-party reservation platform account to Snag Reserve, you further authorize Snag Reserve to use your session with that platform to complete bookings you have requested. You represent that you have the right to authorize this use and that doing so does not violate that platform's own terms.
4. Third-Party Account Risk — No Liability
You acknowledge and agree that any action taken by a third-party reservation platform with respect to your account on their system is entirely outside Snag Reserve's control and is solely your risk. This includes, without limitation: account suspension, account termination, banning, throttling, charges, penalties, loss of reservation history, loss of loyalty benefits, or any other action by the third-party platform.
Snag Reserve is not liable for, and you release Snag Reserve from, any claim arising out of or relating to:
- Any action taken by a third-party reservation platform against your account;
- Any loss of access, credentials, tokens, sessions, reservations, loyalty status, deposits, or credits on a third-party reservation platform;
- Any fees, fines, or penalties a third-party reservation platform or restaurant charges you;
- Any representation made by a third-party reservation platform or restaurant regarding the use of automation, third-party tools, or agents;
- The accuracy, availability, or continued operation of any third-party reservation platform.
You are responsible for understanding and complying with the terms of any third-party reservation platform you connect to Snag Reserve.
5. Subscription, Billing, and Refunds
Snag Reserve is offered on a paid subscription basis, billed through our third-party payment processor. By subscribing, you authorize recurring charges to your payment method at the interval and price shown at checkout until you cancel.
- Cancellation. You may cancel at any time from within the app. Cancellation takes effect at the end of the current billing period.
- Refunds. Subscription fees are non-refundable except where required by applicable law or explicitly offered at our discretion.
- Restaurant-imposed charges. Cancellation fees, no-show fees, prepayments, and deposits charged by restaurants or reservation platforms are between you and those parties. Snag Reserve does not issue refunds for them.
- Non-payment. If a payment fails, we may suspend or downgrade your account until payment is resolved.
6. Acceptable Use
You agree not to:
- Use the Service to resell, broker, or traffic reservations.
- Impersonate another person or misrepresent your affiliation with anyone.
- Use the Service in a way that violates applicable law.
- Attempt to reverse-engineer, scrape, or circumvent security features of the Service.
- Use the Service to harass restaurants, restaurant staff, or other users.
7. Intellectual Property
Snag Reserve and its logos, design, and software are owned by Snag Reserve and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESERVATION ATTEMPT WILL SUCCEED.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNAG RESERVE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID SNAG RESERVE IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST RESERVATIONS, LOST PROFITS, LOST LOYALTY BENEFITS, ACCOUNT SUSPENSIONS ON THIRD-PARTY PLATFORMS, OR DATA LOSS.
10. Indemnification
You agree to indemnify and hold Snag Reserve harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your use of any third-party reservation platform in connection with the Service, or your violation of any third-party right.
11. Termination
We may suspend or terminate your account at any time for any reason, including suspected abuse, non-payment, or violation of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including Sections 4 and 7–10.
12. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Snag Reserve waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by sending written notice to contact@snag-res.app within 30 days of first accepting these Terms.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you in the app or by email. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
